1. Agreement to these Terms
These Terms & Conditions (“Terms”) form a binding agreement between you (“you”, “Customer”) and WarnHack Technologies Private Limited (“WarnHack”, “we”, “our”, or “us”), a company incorporated in India (CIN U62090MP2026PTC082281) with its office at Bhopal, Madhya Pradesh, India. By accessing our website, creating an account, or purchasing any product or service, you confirm that you accept these Terms. If you do not agree, you must not use our website or services.
Where a separate signed agreement, order form, or statement of work exists between you and us, that document will prevail over these Terms to the extent of any conflict.
2. Definitions
- “Services” — the WarnHack website, WarnHack Terminal, and any security assessment, consulting, managed, or training services we provide.
- “Terminal” — the WarnHack Terminal software product and its associated cloud features.
- “VAPT” — vulnerability assessment and penetration testing services.
- “Customer Data” — data, systems information, and content you provide to us or make accessible for the Services.
- “Deliverables” — reports, findings, and other materials we produce for you as part of the Services.
3. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at [email protected] if you suspect any unauthorised use.
4. Our services
We provide secure-access and cybersecurity products and services, including WarnHack Terminal, VAPT engagements, security consulting, and training or workshops. The specific scope, deliverables, fees, and timelines for any engagement are set out in the applicable order form, plan description, or statement of work.
We may update, improve, or modify features of the Services over time. We will not materially reduce the core functionality of a paid plan during your paid term without notice.
5. Acceptable use and security-testing authorization
You agree to use the Services only for lawful purposes and in compliance with these Terms. You must not:
- Use the Services to access, test, or attack any system without proper authorization.
- Reverse engineer, resell, or sublicense the Services except as permitted by law or in writing by us.
- Interfere with or disrupt the integrity or performance of the Services or attempt to gain unauthorised access to them.
- Use the Services to transmit malware, unlawful, infringing, or harmful content.
Authorization for security testing. Where we perform VAPT or similar testing, you represent and warrant that you own the target systems or have obtained all necessary authorizations and consents to permit testing. You agree to provide written scope and authorization before testing begins, and you indemnify us against claims arising from your failure to hold such authorization. WarnHack strictly prohibits the use of our tools, reports, or Deliverables for malicious purposes, and we may suspend or terminate the Services immediately if we reasonably suspect misuse.
6. Orders, fees, billing and taxes
- Fees are stated in the applicable order form, plan, or quote and are payable in the currency and on the schedule specified there.
- Unless stated otherwise, fees are exclusive of applicable taxes (including GST), which you are responsible for paying.
- Subscription plans renew and are billed as described at purchase; you can manage or cancel renewal per your plan terms.
- Late or failed payments may result in suspension of the Services after reasonable notice.
Refund eligibility is governed by our Refund Policy.
7. Intellectual property
The Services, including all software, content, features, branding, and documentation, are and remain the exclusive property of WarnHack and its licensors, and are protected by intellectual property laws. Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your internal business purposes.
Unless your order states otherwise, upon full payment you own the Deliverables prepared specifically for you, while we retain ownership of our pre-existing materials, tools, and methodologies used to create them.
8. Customer Data and confidentiality
You retain all rights in your Customer Data. You grant us the rights necessary to process it to provide and support the Services. Our handling of personal data is described in our Privacy Policy.
Each party will keep the other's confidential information secure and use it only to perform or receive the Services. Security findings and reports are treated as your confidential information.
9. Third-party services
The Services may integrate with or link to third-party products (for example, payment, hosting, or analytics providers). We are not responsible for third-party services, and your use of them is governed by their own terms.
10. Service availability
We work to keep the Services available and reliable, but except where a separate service-level agreement applies, the Services are provided on an “as available” basis. We may perform maintenance and will aim to give reasonable notice of planned downtime that materially affects you.
11. Disclaimers
Security testing reduces risk but cannot guarantee that a system is free of all vulnerabilities. To the maximum extent permitted by law, the Services and Deliverables are provided without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You remain responsible for acting on our findings and for your own security posture.
12. Limitation of liability
To the maximum extent permitted by law, in no event will WarnHack, its directors, employees, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Services will not exceed the amounts you paid to us for the relevant Service in the twelve (12) months preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify and hold WarnHack harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Services, your breach of these Terms, or your lack of authorization for any system we were asked to test.
14. Term, suspension and termination
These Terms apply for as long as you use the Services. We may suspend or terminate access if you materially breach these Terms, fail to pay, or use the Services unlawfully. You may stop using the Services at any time; certain provisions (including intellectual property, confidentiality, disclaimers, liability, and governing law) survive termination.
15. Governing law and dispute resolution
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to any mutually agreed arbitration, you agree that the courts of Bhopal, Madhya Pradesh, India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.
16. Changes to these Terms
We may modify these Terms from time to time. When we make material changes, we will update the “last updated” date above and, where appropriate, notify you. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
17. General
- Assignment — you may not assign these Terms without our consent; we may assign them to an affiliate or successor.
- Severability — if any provision is held unenforceable, the remaining provisions stay in effect.
- Force majeure — neither party is liable for delays caused by events beyond its reasonable control.
- Entire agreement — these Terms, together with any order form and our policies, are the entire agreement between us.
